Lawyers See Need for COR Insurance
According to lawyers at Holding Redlich, companies should consider Chain of Responsibility (CoR) liability insurance against unintended breaches.
Good practice is not enough, lawyers say unintentional breaches are a reality. Under the Chain of Responsibility, consignors, dispatchers, loaders and anyone involved with loading, carrying, packing or receiving can be liable for breaches of the Heavy Vehicle National Law (HVNL).
According to lawyers, businesses can protect themselves by implementing chain of responsibility compliance policies and practices. They also need to demonstrate reasonably taken steps to prevent breaches on their part. They also advise companies to reduce uncertainty and protect themselves with insurance, in case of penalties and heavy fines which could severely impact the business.
They advised companies to look into public liability; professional indemnity; management liability; directors and officers liability and transportation insurances.
